Terms and Conditions

The Oceania Project (TOP) website, www.oceania.org.au and 'iWhales' website, www.iwhales.org (Sites) are subject to the following Terms and Conditions.

Please read these terms and conditions carefully before using the sites. By using these sites, you acknowledge that you have read and agree to all of these terms.

If you do not agree to these terms, you should exit the site/s. TOP may revise these terms from time to time. If you continue to use the site/s after changes are posted to these terms, it will mean that you accept such changes.

Use of Materials on this Site

All materials on the sites, including but not limited to artwork, photographs, graphics, audio clips, video clips, animations, data, text and trademarks ("Content"), are the sole property of TOP or the original creator of such Content and are copyrighted.

You may view, print, copy and distribute the Content only for your personal, non-commercial, educational purposes, provided that:

      (1) you do not modify any of the Content,

     (2) any copies include all copyright, trademark and similar notices, and

     (3) you do not post any of the Content on any other web site or network computer or publish or broadcast any of the content in any media.

You may not use, copy or distribute any of the Content for any other reason without TOP's prior written consent. Any use, copying or distribution of the Content not expressly authorized by this paragraph may violate copyright, trademark and other laws. The trademarks, service marks, trade names and logos ("Trademarks") on these sites are registered and unregistered trademarks of TOP or others. You may not use any such Trademarks for any purpose without the prior written consent of TOP. If you download software from this site, you must agree to the license agreement shown to you prior to downloading. Unless otherwise stated you may not redistribute, sell, decompile, reverse engineer, disassemble, or otherwise reduce the software to a human-perceivable form without TOP's prior written consent. No Warranty or Liability

While TOP attempts to provide accurate information on its sites, TOP, its affiliates, and their respective members, directors, trustees, officers, employees, agents and suppliers (the "TOP Parties") assume no responsibility for, and offer no warranties or representations regarding, the accuracy, reliability, completeness or timeliness of any of the Content. Content is provided "as is" and TOP disclaims all warranties, express or implied, of any kind, including warranties of merchantability or fitness for a particular purpose and non-infringement.

You agree that you use this site at your own risk. Furthermore, none of the TOP Parties warrant that this site will operate error-free or that this site, its server or the content are free of viruses or similar harmful features. Under no circumstances shall any of the TOP Parties be liable for any damages (including, without limitation, special or consequential damages, lost profits, lost data or business interruption) that result from the use or inability to use this site or the Content even if such TOP Party has been advised of the possibility of such damages. Postage, Delivery and Refund Policy

Postage and Delivery:
We will try our best to send your items purchased from iWhales.org within 24 hours of an order being placed.

You should receive your item/s according to the delivery times below, however we are unable to take responsibility for any glitches with Australia Post.

iWhales.org Orders are sent by Australia Post.
  • Within Australia: regular post, cost $7 per item, allow 2 to 5 working days for delivery.
  • Overseas: international airmail, cost $12 per item, allow 5 to 12 days for delivery.
If two or more items are purchased on an order postage is free.
Please note:
As delivery is provided by a third party (Australia Post), The Oceania Project won't be held accountable for late deliveries or loss or damage relating to deliveries.

Please ensure that you enter the correct shipping address as we won't be responsible for undelivered items and will need to charge postage again to resend to an alternative/corrected address.
Refunds:
There are no refunds for purchases involving digitally downloaded products from iWhales.org.

There are no refunds for iWhales.org subscriptions.

For CDs, DVDs or Books from iWhales refunds will be provided if items in order are returned within 7 working days after receipt of order together with original packaging and a copy of the order.

The cancellation fee (refund) policy for bookings aboard The Oceania Projects Whale Expeditions is available on request at expedition@oceania.org.au

iWhales.org Gift Certificate Policy

An iWhales.org Gift Certificate is the perfect solution as your lucky recipient will be able to choose for themselves from range CDs, DVDs, Books and downloadable movies and DVDS available from iWhales.org.

There's no need to worry about spending it all in one go - credit will remain on the Gift Certificate code and is valid for as long as you need. If you buy something in our shop that exceeds the available Gift Certificate credit, you or the recipient simply pay the difference with your credit card or Paypal.

Gift Certificates are sent as HTML emails to you or directly to the recipient.

To buy an iWhales.org Gift certificate use the Gift Certiificate link on iWhales.org. Simply nominate the value, complete the required details on the iWhales Gift Certificate form and proceed to check out. The minimum allowed value of an iWhales gift Certificate is AUD $10.00.

To redeem a gift certificate, simply select the item(s) you want and add them to your shopping cart.

General Provisions

The Oceania Project reserves the right to revise these Terms and Conditions. You accept all such revisions by accessing any part of the Sites or continue to access them after that revision is posted on the sites.

These Sites and any right or obligation under the Terms and Conditions is governed by the laws in force in the State of New South Wales, Australia (other than the conflict of laws rules) and the parties submit to the non-exclusive jurisdiction of the courts of the State of New South Wales, Australia in respect of any action that arises under the agreement.
